We only have access to and collect information that you voluntarily give us. Sandhill Select Horses collects personal information for specific, limited purposes. We collect personal contact information (for example, name, address, email address and telephone numbers) when you register as a member on our website. This information is used to fulfill your request and respond to your inquiries.

We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g.to transportation of a horse, transportation information needed for Health Papers or event information and registration.

Unless you ask us not to, we may contact you via email in the future to tell you about upcoming sales and events, or to notify you of changes to this privacy policy.

You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number given on our website.

Sandhill Select Horses LLC will not sell your information, nor will we make it available to a third party unless there is a request from a law enforcement agency.

In order to bid, a user must first complete the registration form. During registration a user is required to give certain information (such as name and email address). This information is used to create an account for you as well as to contact you about the Sales / Auctions and Classified services on our site. Additional information will be required (such as address, phone number, and credit card) when you apply for a bidder number. This information is used to assign you a bidder number, which allows you to bid on our site and may be used to contact you when necessary. Your credit card is used to ensure you are a real person. Your credit card WILL NOT be charged if you have a winning bid. 

We collect demographic information, as well as purchase history, in order to gain a better understanding of your interests so that we may develop better service.

We may also use demographic and personal contact information to contact you about changes, enhancements or other notices related to our services.

We generally use your personal information for the purposes of managing, administering, reporting, collecting or otherwise enforcing accounts; maintaining business records for reasonable periods of time and generally managing and administering our business; and meeting regulatory, legal, insurance, audit, security and processing requirements. Certain information, your e-mail address for example, is collected solely for identification and contact purposes on our part. Records are only kept for as long as required by law or as long as they are required for information purposes, whichever is longer.

Safeguards

Sandhill Select Horses maintains personal information in a combination of paper and electronic files. Our website has no application that gathers information from your computer.

We may amend these Terms of Use at any time by posting a revised Terms of Use on the Site and or Auction Platform.

While we use reasonable efforts to provide our Sites and Services to you for so long as you are compliant with these Terms, we do not guarantee that they will be secure, or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platforms in order to access or use our Sites and Services. You should use your own virus protection software.

You may use our Sites and Services only if you can form a binding contract with us, in compliance with these Terms and all applicable local, state, national, and international laws, rules and regulations. Any use of our Sites or Services by anyone under the age of 18 is strictly prohibited. OUR SERVICES ARE NOT AVAILABLE TO ANY USERS WE HAVE PREVIOUSLY REMOVED OR SUSPENDED FROM OUR SERVICES. We may suspend or terminate your access to our Services at any time, for any reason (such as your material breach of these Terms, our reasonable belief that it is necessary to protect the safety or property of others, to prevent fraud or for risk assessment purposes) or for no reason. We reserve the right to limit your use of our Sites or Services or terminate your account immediately, without notice or refund of any amounts that you may have paid to us.

All text, names, videos, photos, graphics, trademarks, logos, sounds, artwork, and design on the Site and online are owned or controlled by Sandhill Select Horses. You may not use, copy, reproduce, republish or share any photos, graphics, or information for illegal, unlawful, or malicious activities that we deem improper for any reason whatsoever in our sole judgement. You may not impersonate any person or entity, falsely state or misrepresent your affiliation with any person or entity, or use or provide fraudulent, misleading, or inaccurate information; to defame, abuse, harass, stalk, intimidate, bully, threaten or otherwise violate the rights of others. You may not attempt to access or use or attempt to access another user’s account or login information. You may not collect information from our site or service for any illegal activity.

Please note that we do not have control over and cannot guarantee the quality, safety, or legality of any horse or item offered and no guarantees are made as to the ability to sell any horse or item. 

We have made every effort to ensure our Sandhill Select Horses’ sale platform runs smoothly and uninterrupted; however, services may be subject to limitations, delays, or other problems inherent in the use of the Internet, mobile devises, electronic communications, and mail delivery systems. We are not responsible for any delays, delivery failures, or other damages resulting from such problems. Sandhill Select Horses LLC reserves the right at any time, without notice to modify or suspend or terminate access to the Site or Service or to interrupt the event or sale, as necessary to perform routine or non-routine maintenance, or correct errors or make other changes. 

Limitations of Liability

To the fullest extent permitted by law, in no event shall the indemnified parties – the sale company and owners- be liable for any direct or indirect consequential, special, incidental, or punitive damages, or any damages whatsoever, including, without limitation to damages for the loss of use, data or loss of profits or anticipated profits, business or sales, any loss of goodwill or reputation, or the cost of substitute goods or services arising out of or in any way connected with the use or performance of the site or auction platform, even if the indemnified parties, or an authorized representative thereof, has been advised of the possibility of damages arising out of, based on, or resulting from our services, auction platform or sites. Use of the Auction platform or application is done at your own discretion and risk and users will be solely responsible for any damages of any kind. 

You acknowledge and agree that you will not hold or seek to hold Sandhill Select Horses LLC and representatives, owners, and designees responsible for the content provided by any user, including, without limitation, any translation thereof, we do not guarantee the safety of any transaction, listed item(s) or the truth or accuracy of any listed item(s) or other content provided on our sites and services.

Release

In the event that you have a dispute with one or more other users of our sites or services, including, without limitation, any other bidder or seller, any third party visitor to the sites or the provider of any third party website or application that may be linked to or from our sites or services, you hereby agree to release, remise and forever discharge the indemnified parties from any and all manner of rights, claims, complaints, demands, causes of action, proceedings, liabilities, obligations, legal fees, costs, and disbursements of any nature whatsoever, whether known or unknown, which now or hereafter arise from, relate to, or are connected with such dispute.

Indemnification

You will indemnify, defend, and hold harmless Sandhill Select Horses, its subsidiaries, affiliates, and each of their respective officers, directors, employees, agents, successors, and assigns (the "Indemnified Parties") from and against any claim or demand (including reasonable attorneys’ and experts’ fees and costs), made by any third party due to or arising out of (i) your breach of these Terms; (ii) your improper, malicious or fraudulent use of our Site, the auction platform, or services; (iii) any personal injury, death, or property damage caused by or arising out of the listing, sale, transportation or use of any Listed Item(s); or (iv) your violation of any law or rights of a third party, including related to any User Content you provide or post. You agree to indemnify and hold the company, it’s third-party vendors, affiliates, directors, officers, including but not limited to reasonable attorney’s fees, made by any third-party due to or arising out of any content submitted, posted or breach by you or your affiliates employees, agents and representatives of these terms. 

You agree that each of us may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative or private attorney general action or proceeding.  You therefore agree to waive the right to a jury trial and the right to file, commence or participate in any class action or class arbitration against Sandhill Select Horses LLC, or Jeremy and Jennifer Knoles, employees, designees, or appointees. Unless both you and Sandhill Select horses LLC agrees, the arbitrator may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of consolidated, representative, class or private attorney general action or proceeding.
